Terms of Service

1. Acceptance of Terms

By accessing or using the Ladagx website, mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use our Services. We reserve the right to modify these Terms at any time, and continued use implies acceptance of the updated terms.

2. Your Account

To use certain features, you must register for an account and provide accurate, current information. You are strictly responsible for safeguarding your password and for all activities occurring under your account. Ladagx reserves the right to suspend or terminate accounts that violate our policies, local laws, or engage in fraudulent activities.

3. Ordering & Delivery Services

Ladagx operates strictly as a technology intermediary connecting you with independent Merchant Partners across Ladagx Food, Ladagx Mart, and Ladagx Pharmacy, alongside independent Delivery Partners.

• Role of Ladagx: We facilitate transactions for prepared food, consumer goods, and groceries. We do not own, sell, or resell the products offered by Merchants.
• Pricing: Prices and taxes for products are determined strictly by the Merchant Partners. We facilitate the transaction but are not the seller.
• Restricted Items: For items requiring verification (e.g., pharmacy medicines), you may be required to provide valid prescriptions or government-issued ID upon delivery. Failure to do so will result in order cancellation without refund.
• Delivery: Delivery estimates are guidelines, not guarantees. Unforeseen circumstances (e.g., extreme weather in Ladakh, traffic) may cause delays. Ladagx exercises no control over the independent Delivery Partners.
• Liability: Ladagx is not liable for the quality, safety, or dietary compliance of the products provided by Merchants, nor for any acts, omissions, or delays of Delivery Partners.

4. Fees, Payments & Cancellations

Transactions conducted through the Ladagx platform may attract additional fees. All payments are securely processed.

• Platform & Delivery Fees: You may be charged additional fees including Delivery Fees, Handling Fees, Convenience Fees, and Platform Fees for platform maintenance.
• Delivery Surge: A Delivery Surge may be applied based on distance, time of day, demand, weather conditions, or seasonal peaks.
• Cancellations: Once an order is accepted by a Merchant Partner, cancellations are severely restricted. If you cancel an active order, or fail to receive it due to incorrect address/unresponsiveness, you may be charged liquidated damages up to the total order value.
• Refunds: Refunds for missing or poor-quality items require immediate reporting with photographic proof, subject to Merchant approval. We do not offer refunds against goods already purchased unless an error directly attributable to Ladagx occurred.

5. User Conduct & Content

You agree to treat our Delivery Partners, Merchants, and staff with dignity and respect. Any form of abuse, harassment, or discrimination will result in an immediate permanent ban. Furthermore, you agree not to:

• Post false, defamatory, obscene, or illegal content.
• Scrape, reverse-engineer, or disrupt the Ladagx platform via bots or automated scripts.

By posting reviews or images, you grant Ladagx a perpetual, royalty-free license to use, display, and distribute your content across our platform.

6. Disclaimer & Limitation of Liability

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Ladagx completely disclaims all warranties, express or implied, regarding platform reliability and uptime. Under no circumstances shall Ladagx Technologies Pvt. Ltd. be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.
